TERMS AND CONDITIONS FOR DNA STADIUM SERVICE SUBSCRIBERS

Access to and use of DNA Stadium ("Website") is provided subject to the following terms and conditions, which you should read carefully.

1. Description of the Service

DNA STADIUM ("website") is a marketplace that allows to a Vendor to offer and sell Genetic Tests in a variety of formats and locations, and Genetic Counselors or specialist in Genetics to public their profile and offer advisory; finally DNA Stadium allows to a Genetic Service Provider to offer and sell its products and services as well. As a marketplace, DNA STADIUM does not own or sell the items listed on this site, so the actual contract for sale is directly between you and buyers. DNA STADIUM doesn’t offer genetic counseling, so the actual relationship is between the Genetic Counselors or specialist in Genetics and the Users.

2. Intended Audience

DNA Stadium is a marketplace of genetic testing that help consumers and health care professional to identify appropriate, currently available genetic tests. All users are encouraged to speak with a healthcare provider or a genetics experts for questions regarding genetic tests. The website offers a directory service of either Genetic Counselors and Specialist in Genetics that can help users to find a genetic test or services and, eventually, to interpret the results. The Website and services provided herein are intended for adults. When a minor uses the Website, the parent or guardian of that minor will be held responsible for the minor’s actions. If you don't agree with any of these terms, or if you have any objections to our Privacy Statement you must not use the Website.

3. Responsibility of Vendor of Genetic tests and services, Genetic Counselors and Specialists in Genetics

“You” can be (i) a Vendor of genetic tests, (ii) a Vendor of genetic services or (iii) a Genetic Counselor or specialist in Genetics.

If You are (i) then you have to subscribe the plan: GOLD - Annual fee and Commission rate for Vendors (max 30 products)
If You are (ii) then you have to subscribe the plan: GOLD - Genetics and Genomics,
If You are (ii) then you have to subscribe the plan: GOLD - Genetics Counselors Member Dir.

In all cases, You are responsible for the submitted personal information and responsible against national and international laws about Genetic Testing and Direct To Consumer Genetic testing.  

3.1. Responsibility for Vendors of Genetic tests and services

You as Vendor are responsible for the submitted personal information and responsible against national and international laws about Genetic Testing and Direct To Consumer Genetic testing. 

You are the sole responsible for pricing, shipping, and all other kind of information about the advertised Genetic Testing for Costumers in our Services. DNA STADIUM has no control over and does not guarantee the existence, quality, safety or legality of items advertised; the truth or accuracy of users' content or listings; the ability of sellers to sell items; the ability of buyers to pay for items; or that a buyer or seller will actually complete a transaction or return an item.

Registration as Vendor to the Website accepting these terms results in your information being stored and processed in Italy, and you specifically consent to DNA Stadium of storing and processing the personal data you submit. 

Vendor is also responsible to protect all the companies and personal data received by Users, Customers and Vendors during navigation, sign-up and buying procedures.

Vendor can remove itself and the published products whenever he needs without paying any penalty.

3.1.1. Minimum information in the product page

Vendor shall publish the following information for each product in DNA stadium:

1. Product description or Service Description

2. How the genetic test works 

3. Who can order the test or service

4. Laboratory information including certifications and accreditations

5. Turnaround Time as number of days from the received order to providing the test results or requested service.

6. Company information 

For point 5, the Vendor of Genetic Tests needs to provide the number of days within the sample collection kits will be shipped and the number of days within the test results will be provided.

It is highly recommended to publish genetic testing clinical validity and utility information as well.

3.1.2. Service Payment

You, as Vendor of Genetic Tests, accept to pay an annual fee of 100 Eur for a maximum of 30 products to publish and a commission rate of 10% on the product price paid by the Customer. The commission rate doesn't include the eventual commission rate to be paid to transfer money from DNA Stadium account to Vendor account.

You, as Vendor of Genetic services in the categories of Human, Plant and Animal Genetics and Genomics (not other categories), accept to pay the annaul fee of 20 Eur for a maximum of 2 services to publish. In this case no commission rate is applied except the eventual commission rate to be paid to transfer money from DNA Stadium account to Vendor account. It is recommended to use a Paypal account for receiving payments from DNA Stadium.

3.2. Responsibility for Genetic Counselors or Specialists in Genetics

You as Genetic Counselors or Specialists in Genetics are responsible for the submitted personal information and responsible against national and international laws about Genetic Testing and Direct To Consumer Genetic testing. 

You are the sole responsible for relationship with User.

Registration as Genetic Counselor or Specialist in Genetics to the Website accepting these terms results in your information being stored and processed in Italy, and you specifically consent to DNA Stadium of storing and processing the personal data you submit. 

Genetic Counselor or Specialist in Genetics can remove himself whenever he needs without paying any penalty.

3.2.1. Service Payment for Genetic Counselor

You, as Genetic Counselor or Specialist in Genetics, accept to pay an annual fee of 10 Eur for having the list of services offered by DNA Stadium as follows:

  1. Profile page with personal picture and Text provided by You
  2. Link to facebook and twitter personal pages from the profile page
  3. Personal Picture in the spot area in the left side of the home page
  4. Direct link by clicking in the personal picture (point c) to profile page
  5. Monthly article in the news section of the website

4. Customer responsibility

Customer is the responsible for the submitted personal information and responsible against national and international laws about Genetic Testing and Direct To Consumer Genetic testing. 

5. DNA Stadium responsibility

DNA Stadium is responsible to keep up and running the marketplace with all its procedures. In addition, DNA Stadium is also responsible to protect all the companies and personal data received by Users, Customers, Genetic Counselors, Specialists in Genetics and Vendors during navigation, sign-up and buying procedures.

DNA Stadium is responsible for controlling that all the procedures and policies are respected either from Vendors and Customers.

DNA Stadium can promote genetic tests and services even by means of other channels such us Facebook, Twitter and Google Plus and DNA Stadium Community as well. This list of channels can be extended or limited depending on the promotional strategy of DNA Stadium.

5.1. Payment policy to Vendors of Genetic Tests

DNA Stadium shall pay Vendor once the sample collection kit is shipped from Vendor to Customer. The status of "Shipped" shall be notified to Customer and DNA Stadium by means of the implemented procedure in DNA Stadium itself. The payment is reduced by the commission rate (10%) and the commission to be paid to any service for transferring money to the Vendor. It is recommended to use a Paypal account for receiving payments from DNA Stadium.

5.2. Refund policy to Customers

Customer is eligible for refunding by DNA Stadium if the sample collection kit is not shipped and notified to Customer after the order, while customer is eligible for refunding by the Vendor of genetic tests and services if the DNA test is not completed in the declared time. In case of repetitive complaints from customers and users of DNA Stadium towarsd Vendor, this latter could be removed immediately from DNA Stadium.

In case of Order Cancellation, the Vendor will be charged of a the amount of money for covering the sustained costs by DNA Stadium.

In case of subscribers of the plan GOLD - Genetics and Genomics and GOLD - Genetics Counselors Member Dir, the relationship is directly from users and subscribers. In case of repetitive complaints from customers and users of DNA Stadium towards these subscribers, these latters could be removed immediately from DNA Stadium. Eventual refund is due to Subscribers directly to Customers.

6. Limitations of Content

You may access the Website, use the graphics, information, data, editorial and other Content only for personal or professional use, and download Content only as search results relevant to the intended use. The Content may be downloaded onto mobile devices or desktop. When downloaded, the Content remains subject to the limited use license contained in this Agreement. Bots, crawlers, spiders, data miners, scraping and any other automatic access tool are expressly prohibited. Violation of this limited use license may result in immediate termination of your membership and may result in legal action against you.

The Website is protected by copyright as a collective work and/or compilation, pursuant to Italy copyright laws, international conventions, and other copyright laws.

7. Limitation of Liability

Because DNA Stadium is a marketplace of genetic testing, and does not constitute or contain medical advice or treatment, neither DNA Stadium, nor any of its affiliated companies, representatives or employees shall be liable for any damages whatsoever arising out of or relating in any way to the content or information contained within the website. Sole responsibility for the proper use of the information on Genetic Testing rests with you and user, or those professionals with whom the user may consult.

8.1. Information Collection And Use

DNA STADIUM is the sole owner of the information collected on this website. We collect information from our users at several different points on our Web site. We use the information solely to track how many individuals use our site, which pages they use. This information enables us to improve our site for all customers. We do not share, sell or pass on any of this information to third parties.

DNA Stadium can use product information for promoting genetic tests and services even by means of other channels such us Facebook, Twitter and Google Plus and the DNA Stadium Community as well. This list of channels can be extended or limited depending on the promotional strategy of DNA Stadium.
 
We store information that we collect through cookies, log files, to create a profile of our users.  A profile is stored information that we keep on individual users that details their viewing preferences.  Consequently, collected information is tied to the users personally identifiable information to provide offers and improve the content of the site for the user. This profile is used to tailor a user’s visit to our Web site, and to direct pertinent marketing promotions to them.  We do not share your profile with other third parties

A cookie is a piece of data stored on the user’s computer tied to information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our site. We use session ID cookies.  For the session ID cookie, once users close the browser, the cookie simply terminates. 

Like most standard Web site servers we use log files.  This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user’s movement in the aggregate, and gather broad demographic information for aggregate use.  IP addresses, etc. are not linked to personally identifiable information.

This Web site takes every precaution to protect our users’ information.  When users submit sensitive information via the Web site, their information is protected both online and off-line.

8.3. Limitation Of Liability

To the fullest extent permitted by law, DNA STADIUM, shall not be liable for any loss or damage whatsoever whether direct or indirect and whether in contract, tort, quasi-tort or otherwise, arising out of the use of or reliance on the information contained in the pages of this Web site.

By getting the access of the pages of this Web site and in consideration of such access, you hereby unconditionally accept to hold harmless DNA STADIUM, from any liability for any loss or damage whatsoever whether direct or indirect and whether in contract, tort, quasi-tort or otherwise, arising out of the use of or reliance on the information contained in the pages of this Web site.

8.4. Transmissions To and From DNA STADIUM

In accessing this Web site you accept that electronic mail and other transmissions passing over the Internet may not be free from interference by outside parties and may not remain confidential. In consequence, DNA STADIUM Limited cannot guarantee the privacy or confidentiality of any information passing over the Internet.

9. Modifications of this agreement

DNA Stadium has the right, at its sole discretion, to modify this Agreement at any time. Changes will be posted on the Website and by changing the date of last revision on this Agreement. If any portion of this Agreement or any change to the Website is unacceptable to you or will cause you to no longer be in compliance with the Agreement, you may cancel your subscription. Continued use of the Website now or following posted notices of changes in this Agreement means that you have accepted and are bound by the changes.

This Agreement, including any terms, conditions and policies expressly referenced herein, shall constitute the complete understanding and agreement between you and us, and shall supersede and cancel any prior or contemporaneous understandings and agreements, except as expressly provided otherwise by DNA Stadium.
